Every month during the 87th Regular Session of the Texas Legislature, Dr. Robert Mace and Dr. Todd Votteler provide an update on water-related legislation. The key water committees are Water, Agriculture, and Rural Affairs in the Senate, chaired by Senator Charles Perry (R) of Lubbock, and Natural Resources in the House of Representatives chaired, by Representative Tracy King (D) of Uvalde.

Since our last installment both committees have held hearings and have started the work of going through various bills. The Senate Water, Agriculture, and Rural Affairs Committee has established Monday morning at 8 a.m. as its regular hearing date (although they can change meeting schedules on short notice), while the House Natural Resources Committee has selected Tuesdays at 8 a.m. for its regular hearing date.

So how many bills are there on the Legislature’s plate?

Now that the deadline for filing new bills during the regular session has come and gone, we can tell you that the Legislative Reference Library of Texas reports that members of the Legislature filed almost 7,000 bills and joint resolutions by the March 12 filing deadline (don’t let this fool you, there are still ways to introduce some additional bills). Compare this to the 86th Legislature in 2019, when close to 7,300 bills had been filed by the same deadline.

Below is a list of some of the water-related bills that have been filed to date, much smaller subset of the total mentioned above. In April, we will update you on the progress (if any) regarding key water-related bills. A few bills have now been introduced into one of the committees in the Senate and House. These include:

HB 966 (Burns), Relating to the award of attorney’s fees and other costs in certain suits involving a groundwater conservation district. This bill was introduced and left pending in the House Natural Resources Committee.

HB 1044 (Anchia), Relating to establishing the Texas Climate Change Mitigation and Adaptation Commission to study and address the impacts of climate change in this state. This bill was introduced and left pending in the House Environmental Regulation Committee.

HB 1435 (Lucio III), Relating to a certificate of public convenience and necessity to provide water or sewer service in an area incorporated or annexed by a municipality. This bill was considered in public hearing with testimony in the House Natural Resources Committee. The bill was left pending in the committee.

HB 1874 (Larson), Relating to the provision of technical assistance by the Texas Water Development Board to an interregional planning council. This bill was introduced and left pending in the House Natural Resources Committee.

HB 1904 (Harris), Relating to the use of the water infrastructure fund. This bill was introduced and left pending in the House Natural Resources Committee.

HB 1905 (Harris), Relating to relieving regional water planning groups of certain duties. This bill was introduced and left pending in the House Natural Resources Committee.

HB 2225 (King, Tracy O. | et al.), Relating to the powers and duties of the Parks and Wildlife Department regarding the Texas Water Trust. This bill was considered in public hearing with testimony in the House Natural Resources Committee, which is chaired by the bill’s author. The bill was left pending in the committee.

SB 152 (Perry), Relating to the regulation of groundwater conservation districts [legal fees, petitioning for rule-making, etc.]. This bill was considered in public hearing with testimony in the Senate Water, Agriculture, and Rural Affairs Committee, which is chaired by the bill’s author. The bill was left pending in the committee. The companion bill, HB 666, was introduced and left pending in the House Natural Resources Committee.

SB 306 (Eckhardt), Relating to information on projected changes in weather, water availability, and climate variability in strategic plans of certain state agencies. This bill was introduced and left pending in the Senate Natural Resources and Economic Development Committee.

SB 601 (Perry), Relating to the creation and activities of the Texas Produced Water Consortium. This bill was considered in public hearing with testimony in the Senate Water, Agriculture, and Rural Affairs Committee, which is chaired by the bill’s author. The bill was left pending in the committee.

SB 905 (Perry/Springer), Relating to guidance on the regulations applicable to the potable reuse of wastewater. This was introduced and left pending in the Senate Water, Agriculture, and Rural Affairs Committee, which is chaired by one of the authors of the bill.

  1. There are a few other water bills of significance that could be added to this list that affect wastewater discharges and transparency requirements for TCEQ: HB 3814 (the plastic “nurdle” bill), HB 2368, HB 3801, HB 4489
